I filed 485 on July 2nd with an EAD with receive notice date of march 2007. it is not approved yet. Will I get an EAD even before the I140 is approved or should the I140 be approved for the EAD to be issued.

I have this situation and need some advice or if anyone can share their experiences.
H1b extension was denied with reason of "Employer-employee relationship". RFE was responded to (with requested pay stubs and W-2) and was still denied. Now, attorney from company is filing for MTR. How long does MTR processing take as the case was already existing? Does that matter or it doesn't? How long did it take to get a decision from CIS?
Is it possible to file MTR from company A (employer) and to file a new petition from company B (middle vendor who has direct contract with client)? Can the MTR be withdrawn in favor of a new petition?
Did anyone go for MTR and how many days did it take to get the decision?

Can you use your spouse's cross-changeability after you have filed for your I-140 already ? How time consuming is this for the USCIS to acknowledge ?
i am quite sure you can...infact you can do this at any stage including after filing I-485.
please verify with an attorney...you will need one to do it correctly.

Greetings,
I applied for a green card via a relative application on April 28th of 2001. I am under the 245I law. It has been 10 years since the application and it has been approved. A lawyer told me I have one more year to wait since they are still working on the visas from April of 2001. My question is: What month are they on currently and is there any way I can speed up this process? Is there a website where I can keep track of where the visas are?

Guys, My labor was moved to Dallas Backlog center and got approved in 2006. When I searched its detail in files from flcdatacenter.com, I could not find any labor that matches my ETA number. I am not sure if there is any way to get the details. Though, online status site of Dallas backlog center shows the status but without any usable details. My labor's ETA number starts with D-xxxxx-xxxxx. Does any body has similar ETA number ?

Hi all,
I am going to US this year December. I also took Tickets for my Travel with the same name as in Passport. And in my Passport, my Surname & Firstname are completely mensioned. But my name in all my certificates is in short form like ( S H V My Name). Will this cause any problem in future if I apply for H1B??

I recently got an RFE for my I 485 Application.
Need to prove my non-immigration status from Nov 29 2007 to Nov 24 2008 .
I have I-797 ( H1-B approval ) for the above mentioned period. But My Last Name in the approval has a typo error ( in place of letter A they misstyped U). My Enployer has opened a Service request to correct the Name in H1 B approval. But he is saying that he never got the corrected approval. Time went by and i applied for H1 ext..i got the H1 extension from Nov 25 2008 to Nov 2011.
So My question is
Is it okay to submit all the documention that was sent to USCIS to correct the name along with the I 797,I-94 for the above mentioned period and explain them that we did not recieved the corrected I-797 ? or not
Please suggest me ..

I have an Indian passport and currently working in USA on L1B visa. Before leaving India I initiated the process of getting permanent residence visa from Australia and while I was in USA I got the AU Independent (Migrant) Visa (Subclass 175) visa approved and it was stamped on my passport by the AU embassy in Washington DC.
My queries are:
- I am planning to go for a vacation to India very soon. While returning to USA will it be a problem with my Indian passport having both USA L1B visa and AU migrant visa.
- For the initial entry to AU, I want to go there next year only for a week directly from USA. Will it be a issue for me to enter the US in my return trip
Your advice on this will be very helpful.

In both cases dependent children were approved first, then primary applicant
