Hi,
I am asking this for my sister who is working under J1 (start in October 2007 and valid for 1 year). She already get a J1 visa stamp and re-enter US as J1 status
1. Change of employer is not permissible in J1. Can she submit a new J1 petition and thus ending her current J1 petition early?
2. How about the 2-year home residency requirement (HRR)? Does she need a waiver for the current J1 she is doing now OR can she satisfy the HRR after she finishes with the new J1? The new J1 will not end later than the current J1. So, practically she will be in J1 for 1 year only.
3. Does she need to get another J1 visa stamp and re-enter the US?

Hi
My brother's wife attended interview at delhi consulate for H4 visa and got 220g .
She had all required documents as required but they says " Your application required further administrative process and they will contact her ASAP" .
Attorny - Can you help us what opetions we have . How long it will take before she gets her H4 visa .
My brother is here in USA from last 9 years and never on bench .

1500 H-1Bs were claimed in the last week and just over 20,000 remain for the fiscal year. Based on a four week rolling average (1175), I am projecting the target will be exhausted in 17 weeks which will be February 23, 2011. Folks,
My wife got terminated on Feb 13th, she received her last pay stub on Feb 20th...We haven't applied for a COS till date...Is she now out of Status..??? She was waiting on her last paystub before she can apply for a COS and she received around 24th of last month and now we are all ready to send our documentation for COS to USCIS. During this span of 2 weeks is she considered staying illegal here..??
I was reading somewhere if USCIS receives her COS after her employer h1b revocation, she might be denied her COS...Is this true...??? Please Advise.
I was also reading somewhere about e-filing for COS, is e-filing available for H1 to H4 COS..??

I was checking the http://congress.org
I noticed they have a Calls to Action from Groups and Organization on the home page, When i tried to see if there are any Immigration related issues posted There were many like increasing H2A etc but nothing corresponding to Retrogression or GC waiting faced by thousands of immigrants.
There are 100s of bills waiting for Co-sponsors published on this website.
I felt we should do post about the issues faced by Thousands of Legal immigrants who are struck in retrogression or Per country limit.
This may be a good place to put as a number of representatives may view it and it is a good way for us to let the people know of the issues.
Any thoughts........

Hello,
I recently received my Greencard. Will be getting married in a few months and wanted to find out the options available to sponsor my fiance. Fiance is a british citizen, does that help in any way? Also she is a qualified Doctor in the UK and is planning on taking USMLE part 1 & 2 prior to the wedding. Is it prudent to have her move to the US on an H1B instead?

Need help
I have approved labor for PD 2004 and I-140 got rejected in Dec'2006 due to education credential with 3 year degree. currently my I-290 is pending with AAO appeal for more than 10 months and my extension is based on that.
New labor is filed in June'2007 and got approved in September. I-140 is pending for the new labor.
My Current extension is getting expired in January 2008. If I get premium processed my extension on old case and if my appeal gets denied will my extension or my status gets invalid or I have valid extension upto next January to get other I-140 approval ?
Please let me know ASAP so I can request premium process for extension.

YOu should go ahead and file your response to RFE. I had the same issue with my case when my attorney did not inform me of a RFE. After missing the deadline, I filed my repone through a different attorney explaining the problemand USCIS accepte my response.
